Trump Team Seeks High Court Approval to Fire Leading Intellectual Property Official

The ex- president's administration on Monday petitioned the nation's highest court to allow the termination of the head of the American copyright authority.

This emergency appeal follows roughly six weeks after a national appeals court in Washington ruled that the director, Shira Perlmutter, could not be solely fired.

Nearly one month ago, the entire District of Columbia circuit court declined to review that decision.

This case is the most recent in a series of disputes related to presidential authority to appoint preferred heads at government agencies.

The High Court has mostly allowed such dismissals, even as court challenges continue.

However, this particular matter involves an office within the Library of Congress. Perlmutter serves as the register of copyrights and also advises Congress on copyright issues.

The government's top lawyer, D John Sauer, stated in the filing that, regardless of ties to Congress, the register “wields administrative authority” in overseeing copyrights.

Perlmutter alleges she was terminated in May because the former president disagreed with advice she provided to lawmakers in a document related to artificial intelligence.

She reportedly received an email from the administration informing her that her role was “terminated starting immediately,” as stated by her office.

A divided appellate group decided that Perlmutter could retain her job while the case moves forward.

“The Executive's claimed obvious interference with the work of a Legislative Branch officer, as she carries out legally approved duties to advise the legislature, strikes us as a breach of the division of government authority,” stated Justice Florence Pan for the appellate panel.

Judge J Michelle Childs joined the ruling. Both judges were appointed to the appeals court by Democrat leader Joe Biden.

In dissent, Justice Justin Walker, a Trump appointee, argued that Perlmutter “uses administrative authority in a variety of ways.”

Perlmutter's attorneys have argued that she is a renowned intellectual property specialist. She has acted as copyright director since former head librarian Carla Hayden appointed her to the position in October 2020.

The former president named deputy attorney general Todd Blanche to replace Hayden at the Library of Congress. The White House had fired Hayden following complaints from right-leaning groups that she was promoting a “woke” agenda.
